The US cannabis seed ban explained: what 12 November 2026 means for UK collectors

What's actually changing in America

Since 2018, US federal law has treated cannabis seeds as "hemp" — legal to sell and ship — because the seeds themselves contain effectively no THC. That interpretation ends this November. A provision tucked into the US government's 2026 agriculture funding law (Section 781 of the FY2026 Agriculture Appropriations Act) rewrites the definition of hemp so that a seed's legal status follows the THC content of the plant it came from, not the seed itself.

Since virtually all collectable cannabis seeds descend from plants above the 0.3% THC threshold, they stop being "hemp" and become federally controlled cannabis on 12 November 2026. In practical terms, across the US that means:

There is active lobbying to soften or delay the rule before November — even parts of the US administration have asked Congress to amend it — so the final shape may shift.
