Are cannabis seeds legal in the UK? The 2026 collector's guide

Why seeds themselves are legal

UK drug law is built on the Misuse of Drugs Act 1971, which classifies cannabis as a Class B controlled drug. Crucially, the Act controls the plant and its THC-bearing parts โ€” not the seed. An ungerminated cannabis seed contains no THC at all, so there is no possession offence for owning one, ten, or a thousand of them. That's not a loophole; it's simply how the law is written, and it's why cannabis seeds have been openly sold in the UK for decades.

The line you must not cross: germination

Everything changes the moment a seed sprouts. Germinating a cannabis seed means producing a cannabis plant, and cultivation is an offence under section 6 of the Misuse of Drugs Act 1971 โ€” even a single plant on a windowsill, even if you never harvest it. Penalties scale with seriousness: cultivation and production of a Class B drug can carry heavy fines and, at the top end, up to 14 years' imprisonment for large-scale production or supply.

This is the whole reason the "souvenir rule" exists. A seed in a sealed collector's pack is a legal product; a seed in a propagator is a crime. There is no grey area between the two.
